This session will explore tested investigative techniques employed by leading corporate risk firms. Managing first responders and developing a systematic approach to implementing a cost-effective solution to unexpected events which can empower departments as varied as Human Resources and Information Technology can play an integrated role in the overall objective of the reduction of corporate risk. The vast majority of corporate documents now exist in electronic form. Electronic evidence is fragile and easily erased or otherwise compromised, however new forensic tools allow the cost effective and safe recovery of deleted, hidden and temporary files normally invisible to the user. How can you best protect your evidence from spoliation or negligent modification? What do you do with Electronic Discovery requests? How do you retroactively map network usage throughout the enterprise? Who should be the first responders? What techniques are employed to find the digital smoking gun? Mr.. Laykin manages complex investigations for numerous Fortune 50 companies and will examine the tools, methodologies and case studies which represent the winning and losing strategies of computer forensic and information technology based fraud analysis.

On July 1, 2003, California Senate Bill 1386 became law. Among its ramifications was the requirement for enterprises dealing with personally identifiable information to notify affected individuals in the event of a suspected breach of confidentiality. This part of the law got a lot of press coverage and led to much hand-wringing and "no way" and "we are doomed" statements from various levels of management at various corporations, wherein people entertained visions of conducting massive notifications of tens of thousands of customers and clients any time there was a "suspected" incursion.
In this session, Erik Laykin of OnlineSecurity analyzes what this law actually requires from a business, not legal standpoint. Erik then describes how different companies planned, implemented and are continuing to evaluate and implement appropriate mechanisms to address and resolve not just notification, but all the requirements of this law. Also covered will be these companies' comprehensive assessment of the law's impact including its legal, technological, operational and brand management impacts. Their action plan includes elements of encryption, risk assessment, intrusion detection and other items wrapped in sound management.
Maybe this doesn't apply to you; maybe you don't do business in California or have no clients there or hold no personal information regarding California citizens. But US Senator Diane Feinstein has repeatedly stated that she would like this to be the model for a Federal law. Even if it still doesn't apply to your shop, this is great information on how to respond proactively to a significant change in the legal environment.
