The Use of Computer Forensics in Arbitration

With the pervasive use of computers and information technology in the business world today,
approximately 80% of all corporate data is stored electronically, 93% of all new data is
created electronically, and more than 70% of the data stored electronically is never
reproduced on paper. Thus, in any complex commercial dispute, it is highly probable that
the evidence required to prevail in a matter will need to be obtained from electronic storage.
Computer forensics is the methodology to collect, authenticate, preserve, examine, and
recover that evidence from electronic media.
Litigation has traditionally been the preferred manner for resolving complex commercial
disputes, but over the past fifteen years, arbitration has become a common alternative to
litigation. The arbitration process is less complex and less formal than litigation:
witnesses are not deposed, discovery is relatively restricted, and the rules of evidence
are not as strict. For these reasons, computer forensics is generally used less frequently
in arbitration than in litigation. Nevertheless, there are many instances where it is both
procedurally correct and cost effective to use computer forensics in arbitration.

Effective Use of Damages Experts in Business Litigation

Business litigation today rarely progresses without the use of a variety of experts,
whether as a proactive or reactive measure. Categories of experts include those who
possess specialized technical knowledge and will primarily assist in establishing
or refuting) liability, as well as those with financial expertise who will serve
as damages experts, provide summary testimony that ties together the testimony of
technical experts, and attach a value to the claimed damages. Financial and business
expert involvement becomes especially important in matters involving valuation of
early-stage companies or claims for lost profits for such enterprises.
Following are a number of areas in which damages experts can often be more effectively
utilized in business and real estate litigation. These will not come as great revelations
to attorneys whose practice includes such litigation; rather they are basic principles
and techniques that are often overlooked.
